          B. FUNCTIONS, TASKS, POWERS, AND ORGANIZATIONAL STRUCTURE OF THE ROAD MAINTENANCE MANAGEMENT BOARD
          I. Position and Function
          1. The Road Maintenance Management Board (hereinafter referred to as the Board) is a public service unit under the Department of Transport of Son La (DoT), has legal status, possesses its own seal, and is allowed to open separate accounts at the State Treasury and banks as regulated by law.
          2. The Road Maintenance Management Board represents or performs certain functions, tasks, and powers of the Department of Transport in managing state responsibilities related to the maintenance of provincial roads and national highways that the Ministry of Transport has delegated for management in Son La province. This includes: regular maintenance management, disaster recovery efforts, emergency repairs, and scheduled repairs. The Board is responsible for establishing a road information system and asset data to support management activities.
          II. Tasks and Powers
          1. Carry out the tasks and powers assigned by the Department of Transport in managing and maintaining road traffic infrastructure assets; protecting road land, ensuring road safety corridors, and fulfilling other tasks as stipulated by the Construction Law, Road Traffic Law, and relevant Decrees and Circulars. Specifically, the tasks include:
          1.1. Conducting road inspections on the routes directly managed as regulated by the Minister of Transport;
          1.2. Implementing regulations on the management and protection of road traffic infrastructure. Coordinating with functional departments within the Department of Transport, local authorities, and relevant agencies to manage and protect road land and address violations of road safety corridors. Participating in the clearance and enforcement actions against violations in managing and utilizing road traffic infrastructure. Monitoring and managing construction work within the road safety corridor as per permits.
          1.3. Organizing inspections, reviews, and proposing annual maintenance plans;
          1.4. Organizing the implementation of the steps assigned by the Department of Transport in investment preparation for the management and maintenance of road projects, including: Organizing the preparation, submission for appraisal, and approval of economic-technical reports or repair projects for road works; organizing the preparation and approval of the regular maintenance budget for road works;
          1.5. Organizing the selection of contractors; carrying out tasks assigned by the Department of Transport in signing contracts with contractors for managing and maintaining the projects, as well as contractors for the operation of the projects;
          1.6. Organizing contract management, inspection, supervision, acceptance, and payment as authorized by the Department of Transport. Preparing and submitting the final settlement for completed maintenance projects as required;
          1.7. Addressing the recommendations from regular maintenance units and operational exploitation of road projects regarding repairs, degradation, incidents, risks of incidents, handling black spots, and potential traffic safety hazards; managing and using the road infrastructure;
          1.8. Organizing disaster prevention and traffic assurance; inspecting and urging maintenance contractors to address the aftermath of natural disasters and other force majeure incidents; coordinating the implementation of traffic diversion plans when necessary, according to the decision of the competent authority;
          1.9. Organizing the management and preservation of stockpiles of materials and equipment for responding to the aftermath of natural disasters and other force majeure incidents;
          1.10. Managing, regularly updating, and providing information and data on roadways as required; preparing and archiving records; reporting on the management and use of road infrastructure assets as regulated; collecting and updating data on road infrastructure assets;
          1.11. Exercising the rights and obligations of the investor within the scope assigned by the Department of Transport;
          1.12.  Carrying out other tasks as assigned by the Director of the Department.
          2. Operational funding: Project management funding (the portion to be used) and other legal revenue sources from other activities as regulated.
          3. Facilities: Receiving the facilities assigned by the Department of Transport and managing them according to regulations.
          4. Working relationships: The Road Maintenance Management Board is under the direct and comprehensive direction and inspection of the Director of the Department of Transport, while also subject to state management by competent authorities as regulated; they are empowered to proactively engage and coordinate with relevant agencies, organizations, and individuals to perform their duties.
          III. STRUCTURE
          1. Board Leader include: Director and maximum 2 Deputy Directors
          – Director: Takes responsibility in front of Transport Department Director and the Law about whole action of the Board.
          – Deputy Director: Helps Director in managing some domains, takes responsibility in front of Board Director and The Law about indicated missions. When the director absent, one Deputy Director will be authorized to manage operation of the Board.
          – The appointment, dismissal, transfer, rotation, reward, disciplinary actions, resignation, retirement, and implementation of policies regarding the Director and Deputy Director of the Board shall be decided by the Director of the Department of Transport in accordance with regulations and the delegation of authority from the provincial People’s Committee.
          2. The specialized departments of the Board include:
          2.1. Planning and General Affairs Department: Comprised of a Head of Department, one (1) Deputy Head, and staff according to their functions, duties, and job positions.
          2.2. Management and Maintenance Department: Comprised of a Head of Department, no more than two (2) Deputy Heads, and staff according to their functions, duties, and job positions.
          Head of Department: Responsible for overall management and accountable to the Director of the Board and the law for all departmental activities.
          Deputy Head of Department: Assists the Head of Department and is accountable to the Head and the Board of Directors for assigned tasks.
          – The appointment and dismissal of the Head and Deputy Head of specialized departments shall be decided by the Director of the Board after obtaining written approval from the Department of Transport.
